1. Purpose of the platform
Xaaya is a platform that connects people offering a property for rent (owners, estate agencies, brokers) with people looking to rent (tenants).
Xaaya is neither an estate agency, nor an agent, nor a broker, nor a guarantor. The platform never takes part in negotiating, concluding or performing rental contracts between users.
2. No financial flows whatsoever
Xaaya does not collect, hold or transfer any money. No payment — deposit, advance, rent, processing fee, viewing fee — passes through the platform.
Anyone requesting a payment in the name of Xaaya, by any means (bank transfer, mobile money, cash, cryptocurrency), is committing fraud. Report it immediately.
3. User account
- Creating an account is free and restricted to adults.
- You undertake to provide accurate information and keep it up to date.
- You are solely responsible for keeping your credentials confidential and for any activity carried out from your account.
- An account may be suspended or deleted in the event of a breach of these terms.
4. Publishing listings
Publishing is free and commission-free. Each listing is valid for thirty (30) days, renewable by its author.
- The author warrants they hold the necessary rights over the property offered and the photographs published.
- Information must be accurate: real price, genuine availability, truthful location.
- Prohibited: fictitious listings, duplicates, already-rented properties, misleading prices, discriminatory or unlawful content.
- Xaaya reserves the right to suspend without notice any listing that breaches these terms or is reported by the community.
5. Trust score
Every listing receives an indicative score out of 100, computed automatically from verifiable signals (account verification, media richness, description quality, account age, price consistency with the local market).
This score is a decision-support tool. It is neither a guarantee, nor a certification, nor a commitment by Xaaya as to the existence or quality of the property.
6. Liability
Xaaya provides a hosting and matchmaking service. The platform cannot be held liable for contractual relationships formed between users, nor for any resulting damages.
It is each user's responsibility to verify the identity of their counterpart, the existence of the property, title deeds or management mandates, and the compliance of the lease with applicable law.
7. Moderation and reporting
Any user may report a listing, a message or an account. Reports are reviewed by a human within an indicative timeframe of forty-eight (48) working hours.
Possible measures range from a simple warning to permanent account deletion, without prejudice to any legal proceedings.
8. Intellectual property
The Xaaya brand, its visual identity, its interfaces and its code are protected. Any unauthorised reproduction is prohibited.
By publishing content, you grant Xaaya a non-exclusive, royalty-free licence to display it on the platform, limited to the publication period.
9. Changes to these terms
Xaaya may amend these terms. Any substantial change is brought to users’ attention through an in-app notification.
10. Governing law
These terms are governed by Beninese law and, where applicable, by the OHADA uniform acts. Any dispute falls under the jurisdiction of the courts of Cotonou, after an attempt at amicable settlement.
