3. Legal status of the platform
Xaaya acts solely as a host of content uploaded by its users. As such, its liability can only be engaged once it has actual knowledge of the manifestly unlawful nature of a piece of content and fails to act promptly to remove it.
Xaaya carries out no real-estate brokerage activity within the meaning of applicable regulations: it receives no remuneration linked to the conclusion of a lease, holds no funds on behalf of third parties and issues no mandate.
4. OHADA framework and local law
Lease contracts concluded between users are governed by Beninese law and, for professional and commercial leases, by the OHADA Uniform Act on general commercial law.
Parties are encouraged to formalise their agreement in writing and to keep a copy of every document handed over (land title, ownership certificate, management mandate, receipts).
5. Reporting unlawful content
Any manifestly unlawful content can be reported through the dedicated page or the button shown on every listing. The report must identify the content, state the grounds and include your contact details.
